A former senior UN official has defended Secretary-General Ban Ki-Moon after critics accused the UN chief of failing to take on China and Russia in pushing for a war crimes investigation in Sri Lanka. Ban said he lacks the authority to personally order an inquiry into allegations of mass killings of civilians in the final months of the island nation’s bloody civil war in 2009.

25 April 2011 – The panel of experts set up to advise Secretary-General Ban Ki-moon on accountability issues with respect to the final stages of the conflict in Sri Lanka has found credible reports of war crimes committed by both the Government and Tamil rebels and calls for genuine investigations into the allegations, according to a report made public today by the United Nations. The decision to release the report, which was submitted to the Secretary-General on 12 April and shared with the Sri Lankan Government, was made as a “matter of transparency and in the broader public interest,” Mr. Ban’s spokesperson said in a statement. “The Secretary-General sincerely hopes that this advisory report will make a contribution to full accountability and justice so that the Sri Lankan Government and people will be able to proceed towards national reconciliation and peace,” the statement added.

UNITED NATIONS — Sri Lanka’s decisive 2008-09 military offensive against the country’s separatist Tamil Tigers may have resulted in the deaths of as many as 40,000 civilians, most of them victims of indiscriminate shelling by Sri Lankan forces, according to a U.N. panel established by Secretary General Ban Ki-moon. The panel recommended that Ban set up an “independent international mechanism” to carry out a more thorough probe into “credible” allegations of war crimes and crimes against humanity by the Sri Lankan government and the Liberation Tigers of the Tamil Eelam (LTTE), which held more than 300,000 civilians “hostage” to enforce a “strategic human buffer between themselves and the advancing Sri Lankan army.” Extensive portions of the report were published over the past several days by a Sri Lankan newspaper, the Island, and have been quickly repudiated by Sri Lankan authorities. U.N. officials confirmed the authenticity of the report but said the disclosure was incomplete. They said Thursday that the release of the report had been delayed amid discussions with Sri Lanka over the possibility of including a rebuttal in the report.

It’s a pleasure to be back with the Asia Society, an organization whose work has been unmatched in promoting mutual understanding among, and within the many Asian nations. The last time I participated in an Asia Society program was actually in New Delhi a year ago where I spoke of the importance and strength of the U.S. – India relationship, so it is great to be able to travel just a few hours and not cross any time zones to be with you today. Thank you for the invitation to participate in today’s conversation on Sri Lanka, a country which is important to the United States and significant to me personally after spending three great years there as Ambassador.
